VIP CLUB Terms and Conditions

1. Introduction

These VIP Club Terms and Conditions (Terms) govern participation in a VIP club, loyalty club, rewards club, promotions club, customer list or similar customer engagement program identified on the relevant sign-up form, page, landing page, website, QR code or communication workflow (VIP Club).

The VIP Club is operated by or for the business identified on the relevant sign-up form or page (Business).

The systems, software, customer relationship management tools, communication tools, forms, websites, automations and related infrastructure used in connection with the VIP Club may be provided, configured, hosted, maintained, supported or administered by 7Hours Technology (Service Provider) on behalf of the Business.

By submitting your information through the relevant sign-up form, page or workflow, you agree to these Terms.

2. Participation in the VIP Club

By joining the VIP Club, you request or agree to receive communications from the Business in connection with the VIP Club, including promotional offers, business updates, special campaigns, birthday rewards, loyalty communications, reminders and related direct marketing communications by SMS, email or other approved communication channels, where permitted by law.

Participation in the VIP Club is voluntary and may be withdrawn at any time in accordance with these Terms.

3. Eligibility

By joining the VIP Club, you represent that:

  • the information you provide is true, accurate and complete;
  • you are authorised to provide the contact details submitted;
  • you are legally able to consent to receiving direct marketing communications in your jurisdiction; and
  • you are joining the VIP Club for your own genuine customer relationship with the Business.

The Business may reject, suspend or remove any VIP Club registration that it reasonably considers to be incomplete, inaccurate, unauthorised, unlawful, abusive, fraudulent or otherwise inconsistent with these Terms.

4. Marketing and Other Communications

You acknowledge and agree that:

  • message frequency may vary;
  • standard message, call or data charges may apply depending on your telecommunications carrier or service provider;
  • some communications may be sent using automated systems or third-party delivery platforms;
  • communications may include SMS, email, push, messaging app or similar electronic communications, depending on the channels made available by the Business; and
  • delivery, timing and order of communications cannot be guaranteed and may be affected by carrier, device, network, platform or technical limitations.

Commercial electronic messages sent in connection with the VIP Club are intended to identify the sender and include an unsubscribe facility where required by applicable law.

5. Consent and Opt-Out

Where consent is required by law, the Business relies on the consent you provide through the relevant form, checkbox, sign-up wording, booking flow or other affirmative mechanism used in connection with the VIP Club.

You may opt out of marketing communications at any time.

For SMS or similar mobile communications, you may opt out by:

  • replying STOP where that functionality is available; or
  • contacting the Business using the contact details made available on the relevant form, page, message or website.

For email communications, you may use the unsubscribe facility in the email, where applicable, or contact the Business directly.

The Business will use reasonable endeavours to process unsubscribe or opt-out requests within a reasonable period and without charge, subject to necessary processing time and technical limitations. ACMA guidance states that unsubscribe mechanisms should be clear, work for at least 30 days after the message is sent, not require payment beyond the usual cost of using the service, and be actioned within 5 working days.

Despite an opt-out, the Business may still send non-marketing messages where permitted by law, including messages relating to an existing booking, transaction, customer service issue, legal obligation or account administration matter.

6. Offers, Promotions and Rewards

VIP Club members may receive selected offers, promotions, discounts, rewards, special campaigns or other benefits at the discretion of the Business.

Unless otherwise expressly stated:

  • offers are subject to availability;
  • offers may be changed, suspended, withdrawn or expire at any time;
  • offers are not redeemable for cash;
  • offers may be subject to additional conditions notified at the time of the offer;
  • offers are personal to the recipient and may not be transferable; and
  • the Business is not obliged to make any minimum number of offers or provide offers of any particular kind or value.

7. Birthday Offers

Where birthday rewards, birthday promotions or birthday campaigns are offered, you acknowledge that:

  • such offers may be subject to timing, availability, verification and campaign-specific conditions;
  • no guarantee is given that a birthday reward will be sent, received or redeemable in every case; and
  • inaccurate, incomplete or outdated birth date information may affect eligibility.

8. Use of Personal Information

Any personal information collected in connection with the VIP Club will be handled in accordance with the applicable Privacy Policy, the Customer Feedback, Reviews and Mobile Marketing Policy and any collection notice made available in connection with the relevant customer journey.

The Business is the party offering and conducting the VIP Club and is responsible for determining the purposes for which personal information is collected and used in connection with the VIP Club. The Service Provider may process personal information on behalf of the Business in supplying, operating, supporting, administering, maintaining or improving the relevant systems and workflows.

9. Suspension or Removal

The Business may suspend, limit or remove your participation in the VIP Club at any time, including where reasonably necessary because:

  • false, misleading or incomplete information has been provided;
  • the VIP Club is being misused;
  • unlawful, abusive, inappropriate, deceptive or fraudulent conduct has occurred;
  • continued participation creates legal, technical, operational, platform or business risk; or
  • the VIP Club, a related campaign or a relevant communication channel is modified, withdrawn or discontinued.

The Service Provider may also suspend or limit the operation of relevant systems or workflows where reasonably necessary for maintenance, security, compliance, legal risk management, technical remediation or platform-related reasons.

10. Third-Party Platforms and Delivery Channels

The VIP Club may rely on third-party providers and delivery channels, including CRM systems, SMS providers, email providers, hosting providers, automation platforms, analytics tools, website providers, payment providers and other software or integration providers.

Neither the Business nor the Service Provider controls the independent acts, outages, moderation decisions, restrictions, filtering practices, delivery failures, policy changes, account suspensions or technical limitations of third-party providers or telecommunications carriers.

11. No Guarantee

To the maximum extent permitted by law, neither the Business nor the Service Provider guarantees:

  • the availability, timing, delivery or continued operation of the VIP Club;
  • the delivery, display, receipt or timing of any message, reward, automation, promotion or communication channel;
  • that any offer, reward or campaign will be made available to you; or
  • that the VIP Club or any related system will be uninterrupted, error-free or continuously available.

12. Limitation of Liability

To the maximum extent permitted by law, the Service Provider is not liable for any loss, damage, cost or claim arising from or connected with:

  • delayed, failed, filtered, blocked or undelivered messages;
  • third-party carrier, software, platform or integration issues;
  • outages, synchronisation issues, verification issues or system interruptions;
  • inaccurate, incomplete or outdated customer information;
  • withdrawal, expiry, rejection or unavailability of any offer, reward or campaign; or
  • any act or omission of the Business or any third-party provider.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.

13. Changes to these Terms

These Terms may be amended from time to time.

Any updated version may be published on the relevant sign-up form, page, website or linked policy page and will apply from the effective date stated in the updated version, to the extent permitted by law.

If you continue to participate in the VIP Club after the updated Terms take effect, you will be taken to have accepted the updated Terms.
